Incorrect labelling

A manufacturer of a food supplement failed to include warnings of potential side effects on the label of their product. 
As the safety of the product was in question the product was considered to be defective under the Consumer Protection Act (CPA) and the manufacturer was found liable for damages to the injured person. The client used their products liability cover to defend the claims.

Contaminated ingredients

A manufacturer of a sports nutritional supplement imported ingredients from outside the European Economic Area which were found to be contaminated. The product had been manufactured and distributed to retailers in the UK. The contamination was identified and the product had to be removed from sale as quickly as possible. The client utilised their Product Withdrawal Expense cover to cover the costs of publicising the issue, removing and destroying the product.
